I don't know the facts, but I kinda think the case should be dismissed with prejudice.

I don't know whether this is better or worse than what happened to a colleague of mine in the 90's.
He gave a C, or maybe even a B, to a student in an MBA course.
The student reported him to the school and had him investigated for racial discrimination for not giving him an A.
My colleague was able to defend himself but now the charge is on his permanent record and even defending himself was a royal pain in the behind.
